It's still the same advertising clause with the same effect. Anyway, bugzilla is not a place for this, if you want to debate this, take it to gentoo-dev mailing list.
How about reopening this bug for faad2-2.6.1 which seems to have _really_ fixed the licensing issues (according to Flameeyes' blog)?

2.6.1 is no good to go on technical ground this time: the ABI changed but the soname didn't, Alexis is working on coordinating with Nero AG to have a fix that won't bring us on a different soname than the eventual one Nero will use on a new bugfix release.
