The license is GPL. At least that is what is noted on the download page. Not AS-IS.

The source code is maintained in Gitorious now, and there is some information in the following commit: https://gitorious.org/digger/digger/commit/6ef44e1ba4d1da7271c4d2a7d65e71d22b685863

If he has source copyright, then sure, this is probably OK. Even if it weren't, I do not think we could be hold liable for this guy's potential fuck up. But IANAL.

The question is which version exactly is considered remastered?

And who holds the actual copyright.

To be safe, I would say the package should be bumped to some version derived from the Gitorious repo.

I believe this clarifies that "Digger Remastered" hosted at gitorious can be distributed under the GPL. Closing.
