I thought we'd patched out all the niceness crap..

We didn't patch that one out because it's not really supposed to fail. It doesn't depend on specific niceness but only verifies that ps(1) reports the same nice value. FWICS, it uses something alike: ps -o nice -p <pid> and for some reason, that's reporting "-" for you? oO
