The orinoco wireless driver appears to be the only one missing support for scanning for APs (according to uberlord). He also gave an URL pointing to a patch fixing this:

please integrate that patch into pcmcia_cs/kernel/orinoco ebuild

There's already a stand-alone net-wireless/orinoco ebuild including this functionality.

A patch for pcmcia_cs should be considered, not sure about sys-kernel/gentoo{-dev,}-sources.

since there is a orinoco ebuild now, maybe you could just disable the orinoco drivers in the pcmcia-cs ebuild?

I think that orinoco Gentoo ebuild DOESN'T including monitor mode:

If you try to run "iwprivi eth1" doesn't show "monitor" mode. Plasmahh's driver is the only one supports monitor mode with kernel 2.6. Please, include this driver in portage or update orinoco ebuild.

It seems taht the plasmahh patch is the only one that support monitor mode with cards that have a firmware 8.72.

He doesn't say that it doesn't works with firmwares non-8.72, he says that HE only try out with firmware 8.72.

I haven't an orinoco 8.72 firmware and this patch works fine.

I didn't said that either... I have a 8.72 and an other card with 8.10.
The plasmahh works with both but the pcmcia-cs driver doesn't at least with the 8.72 one.
That's what I said.

You can give it a try, it will probably works with your card. If you don't want to change your drivers, you can download my livecd and check if kismet works. http://www.pentoo.ch.
Th patch for orinoco is the plasmahh one.

Please see if net-wireless/orinoco-0.15_rc2-r2 fixes this issue - I have no problems with scanning here...
