This is not valid and breaks dependency calculation.

Ah, okay.  So what's the correct fix here?  Drop back to EAPI=2 and then bump to 5 when portage is at 5?

I'd say just wait until the portage ebuild is fixed. Reverting will probably cause more trouble, so this bug is merely for keeping track of the issues.
