I realize the problematic part of pax-2.patch is no longer present in the currently availible ebuilds.

As of the day before yesterday Justin removed the multitude of patches in the files directory, leaving a new pax-3.patch.

The new pax-3.patch does no longer contain the problematic part of pax-2.patch:

So, maybe the problem is fixed in current versions, at least it looks good for now.

I need to do some "real world" work, can't test if it works at the moment, but now you know some progress happened and can take a test yourself.

I just marked 2.6.32-r170, 3.2.46-r1, 3.9.5 stable..  Please test and if this is still an issue reopen.
