This may be desired behavior, but when I set a commit-hash for EGIT_COMMIT for example I could argue that this is not a live-ebuild. However repoman will complain about it. What is the position from the portage developers on this?

Anyway, I'd suggest to create a snapshot. One of the reasons for not using the vcs directly is to avoid excessive load.
However distfiles-local infrastructure is not provided for maintainers of overlays, so LIVEVCS.unmasked check could be disabled when repo_name != gentoo.
