CONFIG_NET_RADIO has dissapeared from the kernel since v2.6.21...
for my next try i disabled that check in the ebuild but got the following error:

i tried it but it didn't really work so i thought it might work with the original driver

Unlikely you get such an old driver to compile/work. net-wireless/ieee80211 is most probably not going to work again either, see bug 271587. You should try to get the in-kernel driver to work.

This package is ancient and the driver already incorporated into the kernel-sources. No chance to get this package fixed for any newer kernel version.
