Bug 196138 – emerge ati-drivers 8.40.4 with 2.6.23-gentoo kernel leads to sandbox access violation

I updated recently to 2.6.23-gentoo and wanted to re-generate ati-drivers 8.40.4, which DID install with the kernel 2.6.22-r6 I used previously. emerge reported:

Drivers 8.39.4 had the same problem, so probably it has something to do with the
kernel update.

1.install and compile and boot gentoo-sources-2.6.23
2.emerge ati-drivers
3.

Actual Results:  
ACCESS VIOLATION during meerge

Expected Results:  
installed graphics driver
