The freetype package has a bindist useflag that controls subpixel rendering with the cleartype methodology. All the patents listed at https://www.freetype.org/patents.html have expired today. Thus I believe the bindist flag can be removed and the feature can be always enabled.
Having had a look a moment ago at all the Google Patents links posted on the aforementioned FreeType Web page, US6282327, US6393145 and US6624828 are still listed as active.

It seems that Google Patents have now been updated. All of them seem to be expired.
