the licenses is found under docs/LICENSE.TERMS, there it reads:

... to use, copy, modify, distribute, and license
this Software and the Documentation solely for the purpose of
implementing the FastCGI specification ...

Which is much more restrictive then the Apache licenses. I think mod_fastcgi
does not qualifie as open source.
