yes, i am running 2.0.38 driver@zen driver $ emerge --version Portage 2.0.38 sorry i didnt mention that before. i rsync'ed emerge again this morning and still had the same problem. perhaps its gentoo 1.3 ?
are you running this as root ? if not, if you run it first as root then as non-root, does the error go away ?
