I am unable to reproduce the issue using rsync.europe.gentoo.org or rsync1.de.gentoo.org. It's no problem. rsync is supposed to overwrite modified files, so I'm curious why that wasn't happening in your case. Probably not worth spending a lot of time to figure that out, however.
