sys-firmware/intel-microcode-20191115_p20200209::gentoo was built with the following:
USE="hostonly initramfs split-ucode -vanilla" ABI_X86="(64)"
Comment 1 Till Schäfer 2020-05-12 11:02:02 UTC
still valid for sys-firmware/intel-microcode-20200508_p20200508
Comment 2 Thomas Deutschmann (RETIRED) gentoo-dev 2020-05-12 13:10:25 UTC
It's not a bug of this package.
It's a feature of the new mount-boot eclass, see https://gitweb.gentoo.org/repo/gentoo.git/commit/?id=2d90570e81469bf75b2d4a4275151e282632c18e. However, that functionality was removed because it didn't really work in latest portage anymore.

tl;dr
If you really want to do that, create your own wrapper which will mount and unmount /boot before/after calling emerge.
