Yes, it is funny, though engineer societies often are in my experience. However, according to their page the ODA libraries may be distributed as part of programs that are distributed for free to the public. It seems to me that this would include Gentoo. Therefore, only one person has to apply for membership, grab the libraries, and distribute them through Gentoo. I'm sure the application process (gag) would clarify whether this is the case or not. If I'm right then this shouldn't stand in the way of distribution through portage, as users wouldn't have to apply for membership to use the libraries.

Having a read of http://www.opendesign.com/join I say not, or rather that person would have to be a Founding member of the ODA. I need access to this library so I'm joining, If I work out a way of giving gentoo access to it I'll let y'all know M
