I even tried with USE=mplayer but it still pulls ffmpeg. So I can not do an emerge -uD world 

How do I resolve this?

IIRC k9copy hard-requires ffmpeg, thus there is no solution.

Ok is there a proper way to keep ffmpeg instead of libav?

I tried masking stuff but that didn't seem to work.

You could try turning off the libav USE flag and running emerge --changed-use world
