This looks somewhat similar to bug 470166. What version of sys-devel/patch do you have? Your system uses some fairly obsolete packages. Try sys-devel/patch-2.6.1.

In any case, consider updating the whole system by 'emerge -uDN world' on a regular basis - there's the concern of security and new features. I bet that would fix your problem too, whatever it is.
