In ati-drivers ebuild write that =x11-drivers/ati-drivers-12.6_beta_pre897 depends on =x11-base/xorg-server-1.12.49 [-minimal].

Is possible that higher versions of xorg-server support this legacy drivers for mobility ATI RadeonHD <5000 video cards?

We cannot change the binary-only proprietary driver in this regard. You have to ask AMD to release an updated version with xorg-server-1.13 compatibility.
