Seems to be only a stage1 problem, stage2/3 contain depscan.sh
Maybe I misunderstood the error message a little. The problem is that this error message bumps up, not that depscan.sh is missing.
No, you're right. The symbolic link /etc/init.d/depscan.sh points to nowhere. There's no /sbin/depscan.sh.
This is a known bug. env-update always assumes that depscan.sh is present in the system. A patch has already been created and will be in one of the future portage-versions. This error message is just a cosmetic problem.

How is this cosmetic/fixed? depscan.sh is supposed to be part of baselayout, the package is marked as installed, and the file is missing. I just tried installing from 2005.1-r1 which is the latest stage I found on mirrors, and the file is still missing.
