With 2.6.38, bluetooth doesn't work any more. It's already fixed upstream (link to patch provided). Reproducible: Always Steps to Reproduce: Install kernel 2.6.38 enable bluetooth hci0 is up, but no bluetooth device can be found to work around it, one has to manually execute: hciconfig hciconfig -a (that resets the adapter and bluetooth starts working again) I'm marking it as major but, as quite a few people use bluetooth keyboard/mouse
Link to patch provided in URL, but here it is again: http://git.kernel.org/?p=linux/kernel/git/padovan/bluetooth-next-2.6.git;a=commit;h=b99faf1b798d6d0e33526fd2cef55a405c08ff09
I count over 18 patches to just one of those files before the one you provided. This would be quite a backport.
If that's a big backport, maybe it's worth waiting for 3.6.38.1 and as soon as it's out remove current version. Padovan already confirmed it will be part of 2.6.38.1
It seems 3.6.38.1 was released and this patch didn't land there :S I'll poke maintainer to see what can be done.

I think related thread is: http://marc.info/?l=linux-bluetooth&m=129693391117603&w=2
Other part with thread with patch: http://www.spinics.net/lists/linux-bluetooth/msg11661.html
that patch allies clearly on 2.6.38 and works fine :) http://www.spinics.net/lists/linux-bluetooth/msg11667.html
The patch was backported to -stable and will be included in 2.6.38.4. Thus this bug can be closed with the next genpatches release, containing 2.6.38.4 patch.
2.6.38.4 released in gentoo-sources-2.6.38-r3
