fontspec.sty from dev-texlive/texlive-xetex-2010 unconditionally requires the package expl3.sty via:
\RequirePackage{expl3,xparse}

 ~ % kpsewhich fontspec.sty
/usr/share/texmf-dist/tex/latex/fontspec/fontspec.sty
~ % qfile -v /usr/share/texmf-dist/tex/latex/fontspec/fontspec.sty
dev-texlive/texlive-xetex-2010 (/usr/share/texmf-dist/tex/latex/fontspec/fontspec.sty)

expl3.sty is provided by dev-texlive/texlive-latex3, so texlive-latex3 should be added to the DEPEND list.
