The gentoo patchset for apache 2.2.9-r1 which is 20080829 isn't applied correctly as it tries to apply...

sed: can't read /var/tmp/portage/www-servers/apache-2.2.9-r1/work/gentoo-apache-2.2.9-r1/patches/03_all_gentoo-apache-tools.patch: No such file or directory

when the actual filename is ...

03_all_gentoo_apache-tools.patch

Notice the "gentoo-apache" instead of "gentoo_apache"

Yep. The error is in line 444 and line 449 of the apache-2.eclass or in the patch-name, whatever view you prefer. ;)

Obviously just a prefix problem. gentoo-x86 doesn't have any patches in www-servers/apache/files/

Need to look into, I guess.
