When applying the patchset some ~ files are missing, breaks the ebuild.

Reproducible: Always
Steps to Reproduce:
1. emerge sys-kernel/gs-sources/gs-sources-2.4.21_rc8.ebuild

Actual Results:  
Checking 40_cpu_freq.patch (plain text format)... The next patch would delete
the file Makefile~,
which does not exist!  Skipping patch.

released 2.4.22_pre2 gs-sources today, should fix issue.

I did see the following error, but this appears to only be in the documentation. (Which 
will still be nice to have :)
