Could you please post the output of 'emerge info'
and  'emerge --debug mod_php' ?

What apache version(s) do you have installed?
Could you also please try again with the latest copy (sync then try).

i have no need for apache, so i haven't got it installed. 
i first mentioned the broken ebuild with an emerge -s packagename, there mod_php was listed with this aux_get failure. then i tried an emerge --debug mod_php-4.3.2-r2.ebuild and it gives me this output. wether or not there is no apache on my system the aux_get error is too there with an emerge -s and i think this is an missbehavioer of this ebuild because it shouldn't behave this way.

Ah, you didn't mentioned that all you did was 'emerge -s mod_php' previously, am I 
correct? 
 
So you don't have either mod_php or apache installed, and you did something 
along the lines of 'emerge -s mod_php' and got the aux_get error? 
 
I don't see why tho.

yes, exactly. an emerge -s mod_php gives me an aux_get error and i have no version  of apache and mod_php installed. but i still get this error with an emerge -s.
