Do you have insufficient rights on your /usr/portage/distfiles/cvs-src/ directory? Anyway. Delete the emacs subdirectory therunder and retry please.
After deleting /usr/portage/distfile/cvs-src and /var/tmp/portage/app-editors it worked. Resolved. Thank you very much and sorry for the noise.
