Can you still reproduce this error? I suspect this was fixed along the way awhile ago, I cannot reproduce it here. Forced e2fsck works as expected. Tested using stable baselayout-1.12.11.1, e2fsprogs-1.40.8 and unstable kernel 2.6.24-r1.
Bug appears resolved. Closing as TEST-REQUEST, re-open if you're still having the problem.
The server this bug occured on, is running critical services at the moment. I can't test it right now, because I cannot afford any downtime to occur until June.
