The same works Ok with vanilla kernel (just in case that information is required)

If you could attach your /usr/src/linux-2.4.20-r1/.config file that would be really good. 
 
I've just patched the 2.4.20-r1 kernel using the bootsplash patch and it builds and 
boots fine for me.

bootsplash 3.0.7 is in gentoo-sources-2.4.20-r3 and seems to compile fine. 
please feel free to reopen if you have evidence otherwise.
