The upstream location for JAI appears to have changed. The new URL http://jai.dev.java.net/binary-builds.html allows downloads without any license click-thru, so it should be possible to move away from the fetch restriction now.
Thanks. I just updated the existing ebuild for now, because the distfile is the very same. For the new version we shall look at the build from source possibility.

But since there is no longer needed the click-through for download, we don't need the fetch restriction, or am I wrong?
