Why not? we would have a rock solid support for unionfs and let us to start to use it on LiveCDs/DVDs ?

What's wrong with sys-fs/unionfs? And read http://dev.gentoo.org/~dsd/genpatches/faq.htm before requesting kernel patches,  please.

Nothing wrong but, sys-fs/unionfs builds a kernel _module_ !

Get it accepted upstream please, that way it will appear in gentoo-sources automatically. Also, catalyst/genkernel already support unionfs through the sys-fs/unionfs package, even though it does build a module.
