This isn't really a bug, but I've always thought it would be a good idea to have
the ati-drivers ebuilds check if the fglrx kernel module was compiled
successfully, and abort if it wasn't. Since most people are going to be emerging
ati-drivers in order to get 3D acceleration, and since you need the fglrx module
to get 3D acceleration working, it seems like it would be a sensible thing to
do. I know there is a warning displayed by the ebuild already if the compilation
fails, but I've seen people on the forums having trouble getting the driver
working because they haven't realised they don't have the module available.

I'd rather avoid that. I'll think about a solution (as in putting an ewarn if
!opengl or a die if the flag is set)
