This is known and is fixed in the new PHP packages, please use them. dev-lang/php-4.4.0 with USE flag "apache2" is probably what you search, please check http://svn.gnqs.org/projects/gentoo-php-overlay/ and the upgrade docs [1] on how-to upgrade to the new PHP packages.
