When emerging kernels like mm-sources (starting as of 2.6.11), the patch failes to apply, since the Makefile has been changed.

Reproducible: Always
Steps to Reproduce:
1. copy mm-sources-2.6.11_rc5-r1.ebuild to mm-sources-2.6.11-r1.ebuild and run ebuild digest on it.
2. emerge it

Actual Results:  
It fails to apply the mm patch

Expected Results:  
It should apply the patch first, and then do the sed.

it would seem to be a pretty nasty design flaw in the eclass, i dont understand why one would wanna modify the kernel before all patches are applied....

this is fixed in cvs.
