Did you report this upstream, e.g. in the forums or bugtracker? If so, may I ask for the link?
Alright, I have put the virtualbox-4.3.22 ebuild into poly-c overlay. Feel free to give it a try. It still fails for me. I cannot report this upstream as Oracle killed my old bug tracker account after they took over VirtualBox. I have big trouble finding the cause of this problem. I cannot update dev-util/kbuild because of some obscure stack smashing errors during the bootstrap and I cannot find anything suspicious in the 32MB diff between virtualbox-4.3.20 and virtualbox-4.3.22. I am really out of ideas here. Any help is highly appreciated.

Weird, compiling pure oracle package (not through ebuild) seems to be working ok. So there is something to in the ebuild. Continue checking...

I'm successfully using virtualbox 4.3.22 from poly-c overlay. It seems the KBUILD_PATH line has been removed from the ebuild as suggested in the previous comment.
I can confirm that virtualbox from poly-c overlay works for me. But there is still a problem with x11-drivers/xf86-video-virtualbox-4.3.22 The first problem is that the patch xf86-video-virtualbox-4.3.6-link-lazy.patch was not in the files subfolder and manifest file. After fixing that, compile fails see attached log.
