emerge =x11/ati-drivers-14.9-r1 fails to patch as in title. emerge =x11/ati-drivers-14.9 has no problem.

No, it is not fixed. Two different patching sequences. Two different patches with similar names. nohotplug.patch != fix-the-linux-3.17-no_hotplug-error.patch

You need to update your user patch (nohotplug.patch). Nothing else will work here.
