I had the same problem. The file was missing from gentoo-dev-sources/files but a search found similer files in all the other kernel directories. Just gentoo-dev-sources was missing the patch. I decided to do a quick rsync before confirming this bug and sure enough i saw gentoo-dev-sources-2.6.5.CAN-2004-0109.patch come in. Package now emerged successfully. Looks like someone forgot a file, slapped themselves on the head and fixed it. This bug should be closed. Works (now) for me.
