When emerging nginx, the following is displayed at the very end of the process:-


* Detected file collision(s):
 * 
 * 	/var/www/localhost/htdocs/index.html
 * 
 * Searching all installed packages for file collisions...
 * 
 * Press Ctrl-C to Stop
 * 
 * None of the installed packages claim the file(s).
 * 
 * Package 'www-servers/nginx-1.2.5' merged despite file collisions. If
 * necessary, refer to your elog messages for the whole content of the
 * above message.

Giving a few seconds to cancel the action before blindly proceeding is unacceptable. In this case, the file /var/www/localhost/htdocs/index.html was a live web page on my apache installation. No attempt was made by the package installer to backup the original file.

This is the same issue as bug #449136 but we really need that fix applied to stable 1.2.5 or we need ~1.2.6 stabilized ASAP.  This is a very rude thing for a webserver package to do.

How is this marked as resolved when it has not been fixed in the stable version?

It's a duplicate, the actual resolution status can be obtained in the other bug.
