This is definitely no free software, so it shouldn't be labelled as such.
LICENSE="as-is" is not correct.

Probably it needs to be mirror restricted, too.

Whats the problem with the as-is license ? It accurately describes the state of the software it is "as it is".
Gentoo is not mirroring the software itself.
There has not been any recent changes in the licensing of this software. 
Please unmask this.

Does it? "Permission to use, copy, modify, and distribute this software and its documentation for any purpose and without fee is hereby granted, [...]"?
