Initially reported in https://bugs.gentoo.org/show_bug.cgi?id=296868#c3. Need to check this at time 2.6.33 will be out.

Looks, like it would work.
Personally, I used a kernel version conditional patch
with the same effect.
Other than this, it seems to work with 2.6.33.

The suggested fix works with gentoo-sources-2.6.33
vhba-1.2.1 fails to build without it.

Patch to fix this issue was just commited. Fixed.
