media-tv/mythtv-0.21_p19961 won't compile Failed Patch: mythtv-0.21-bttv.patch!

I get the failed patch message when trying to compile mythtv on a 2.6.28 kernel

Reproducible: Always

Steps to Reproduce:
1. emerge mythtv on system that uses a bttv card 


Actual Results:  
as above

Expected Results:  
mythtv to compile 

PATCH COMMAND:   patch -p4 -g0 -E --no-backup-if-mismatch < /usr/portage/media-tv/mythtv/files/mythtv-0.21-bttv.patch
