I found the reason: from the changelog of e2fsprogs-1.40.5:

Remove the --enable-dynamic-static configure option, and build e2fsck
dynamically by default.  If the user wants e2fsck.static, he/she will
need to build it via "make -C e2fsck e2fsck.static"

..please update the ebuild accordingly, many thanks!

sorry, this is not a duplicate. in the moment, we get no static binaries at all. see comment #1. 

one has to insert "make -C e2fsck e2fsck.static" into the ebuild, if USE=static
I tried to do this and send a patch, but my ebuild-knowledge is not deep enough :-(
