Gentoo says app-arch/unace is under the GPL-2, but the archive the ebuild downloads says:

the source may be distributed and used, 
but I,Marcel Lemke, retain ownership of
the copyrights to the source.

1. That's not the package the ebuild uses, but it's not the GGPL either.
2. Yes, it should have its own license label (personally I'd prefer that this and all other nonfree packages be removed from the portage tree, but I doubt that'll happen anytime soon).
