That's pretty difficult to fix unfortunately :(

That particular issue is fixed in svn r5387 and r5389 which defer the warning message until later. Those changes were released in 2.1.2_rc4-r2. There are still some other warnings that may be displayed in color though. I suppose we can disable color up until the point where it's certain that color should be enabled (after loading EMERGE_DEFAULT_OPTS from make.conf).
This is fixed in svn r5625.
