The bigger problem is that these are not a copyright license, but terms of service.

In absence of anything better, maybe we should change the ebuild to LICENSE="all-rights-reserved"? AFAICS, the tarball can be downloaded from upstream without agreeing to any terms. (If we decide to do this, the ebuild should dodoc the LICENSE file from the tarball.)
