Is the patch submitted to the main kernel.org tree? Is it already in the 2.6.10-rc3 kernel? If so, please reopen this bug and attach the patch you want to have applied. If not, please pester the developer to get the patch accepted upstream. The page says the patch is accepted by Vojtech Pavlik (kernel input maintainer IIRC), but isn't in kernel yet. It's still true, it's not even in the bitkeeper repository yet. That being said, the patch itself is a simple 3-line fix and does fix a fatal error.
