The package has the following DEPEND:

  pax_kernel? ( sys-apps/paxctl sys-apps/elfix )

However, I don't see any other usage of 'use pax_kernel', and FWICS it just uses pax-mark like any other ebuild.  Can the extra dep be dropped then?

Sure. PaX support is broken tree-wide anyway. You can't make it worse.
