apache-1.3.32-r1 applies 03_all_gentoo_suexec_pam.patch without checking whether the pam flag is present. If the system doesn't have pam, this causes a compilation error. I noticed that apache-1.3.32-r1.ebuild checks the pam flag before inserting some files into /etc/pam.d, so I think it only makes sense for it to also check whether it should apply this patch.

this is fixed in version 1.3.33-r1 which is currently hard masked due to major changes with apache installation.
