ebuilds with epatch_user pick patches in /etc/portage/patches but do not in ebuilds using EAPI 6 that use eapply_user.

This includes the ebuild for paludis itself which cannot apply its own user patches

Sounds like something you should ask for upstream.

Upstream does that on purpose. Can't do much about that, and I'm not really into patching it on Gentoo level.
