Also, post the output of `emerge -vpq sys-devel/patch'.
Also, why is your system so outdated?

As said earlier: what's your version of sys-devel/patch ?
And as usual - post your emerge --info

upgrading sys-devel/patch solved the problem for me.

There are too much problems that could lead to broken things if you have outdated system and new userland.

If you encounter such problems - basic solution is:

emerge -u @system

Checks for patch version in such cases should be added only for base-system packages
