Spanky thought this was a dup of bug 9849, it's not really.  You're worried because of the stuff at the end of the baselayout ebuild, right?
 *   can't create /dev/.keep
 *   can't create /dev/pts/.keep
 *   can't create /proc/.keep

For the baselayout-1.9.0 ebuild I've added some messages:
 * Some of these might fail if they're read-only mounted
 * filesystems, for example /dev or /proc.  That's okay!
 *   can't create /dev/.keep
 *   can't create /dev/pts/.keep
 *   can't create /proc/.keep

I hope that helps alleviate the confusion.

okay, baselayout-1.9.0 is in portage
