the file does not seem to be in the portage tree.

exact error:
 FATAL: unable to locate:
 * /usr/portage/sys-kernel/gentoo-dev-sources/files/gentoo-dev-sources-2.6.5.CAN-2004-0109.patch
 * for read-only. The file either has incorrect permissions
 * or does not exist
and the file does not exist.

gave error message located above and did not compile/extract/install

installed correctly

I also cannot merge this ebuild. The requested file is definitly not in my portage tree.

It's fixed in CVS a few hours ago; so it should be in the rsync mirrors if you just "emerge sync". Sorry for the trouble!
